New Items and Announcements
The Judicial Conference of the United States has published its "Revision of Certain Dollar Amounts in the Bankruptcy Code Prescribed Under Section 104(b) of the Code" (the "Revision").
The Revision increases dollar amounts in certain sections of Titles 11 and 28. These adjustments are effective for cases filed on or after April 1, 2007. A copy of the Revision may be accessed by clicking on the link below.
Revision of Certain Dollar Amounts Prescribed Under 104(b) of the Bankruptcy Code.
Security Code Now Required on Payment Screen
Effective February 1, 2007, all CM/ECF users will be required to complete the credit card security code field when paying fees through the pay.gov system. The credit card security code is printed on the back of the credit card and is usually 3 digits. The field for the security code has been on the data entry screen in ECF, but its use has been optional. This nationwide change making entry of the code mandatory is being implemented to help protect credit card holders from erroneous charges.

Unclaimed
Funds List (added 07-27-04): Unclaimed
funds are funds held by the court for an owner or recipient who is entitled
to the money but who failed to claim ownership of it. Most unclaimed funds
arise when dividends (assets) are distributed to creditors pursuant to
settlement of a bankruptcy case, but the property goes unclaimed. Some
are the result of refunds to the debtor from his estate. In both cases
the original attempt to distribute the funds was unsuccessful and the
funds were deposited into the United States Treasury pursuant to 11USC
section 347(a).

ATTENTION
- NEW PROCEDURE IN JUDGE EVANS’ COURT, EFFECTIVE
05-01-04:
Relief from Co-Debtor Stay. In accordance with 11 U.S.C. § 1301(d),
motions for relief from co-debtor stay that are made under 11 U.S.C. §
1301(c)(2) will not be heard unless an objection is filed as provided
in the following hearing notice language (hearing notices sent out on
or after May 1, 2004, will include this language):
NOTICE TO CO-DEBTORS: Pursuant to 11 U.S.C. § 1301(d)
(applicable only in Chapter 13 cases), if the motion for relief from
co-debtor stay is made under §1301(c)(2) (the debtor’s plan
does not propose to pay creditor’s claim), a debtor or co-debtor
must file a written objection to the motion within twenty (20) days
of the date of this notice, or an order granting the relief requested,
as to the co-debtor, will be entered without further notice or hearing.
The moving party will be responsible for submitting to the
Court a proposed order granting the relief requested.
PLEASE NOTE THAT UNLESS A CREDITOR SPECIFICALLY MOVES UNDER
AND CITES § 1301(c)(2), THE CO-DEBTOR RELIEF FROM STAY WILL REMAIN
ON THE DOCKET UNLESS SETTLED PRIOR TO HEARING! (added 04-28-04)
On April 1, 2004, automatic
adjustments to the dollar amounts stated in various provisions of the
Bankruptcy Code will become effective. These amended dollar amounts will
apply to cases filed on or after April 1, 2004. These amended dollar amounts
will affect the eligibility of a debtor to file under Chapter 13, certain
maximum values of property that a debtor may claim as exempt, the maximum
amount of certain claims entitled to priority, the minimum aggregate value
of claims needed to commence an involuntary bankruptcy, and the value
of "luxury goods and services" deemed to be nondischargeable. Two of the
Official Bankruptcy Forms contain references to several of the affected
dollar amounts. Accordingly, Official Form 6E, Schedule of Creditors Holding
Claims Entitled to Priority, and Official Form 10, Proof of Claim, will
be changed. (added 03-19-04)
